1 - Introduction and acceptance of Conditions of Use
These conditions of use (“Conditions of Use”) relate to your use of Connected Cars A/S’ application (“the Application”), which is managed by Connected Cars A/S, Park Allé 355, 2605 Brøndby, Denmark, company registration no. 38 15 30 80 (”Connected Cars”). In the event of any changes to the Conditions of Use, you will receive push notifications to your smartphone and/or other selected digital contact points as well as when you log onto the Application or the Websites. At the same time, you will be asked to read and accept the changed terms and conditions. By selecting “I accept” at the bottom of this screen, you agree to use the Application and Connected Cars’ services in accordance with the terms and conditions laid down in these Conditions of Use.
2 - Use of the services
In order to create a user account, you must (i) be at least 18 years of age and (ii) be the owner/user of the vehicle on which the hardware used for Connected Cars is installed. Once you have created a user account, you will obtain access to the following options via the Application and the underlying cloud infrastructure:
- Information about your vehicle’s location and condition.
- In the event of problems with the vehicle: precise and easily understandable information about how to proceed
- Specific advice on your vehicle from your preferred garage, based on the precise condition of your vehicle, via straightforward digital communication
- In the event of an accident: assistance from the SOS Dansk Autohjælp due to transfer of information from your vehicle
You gain the right to use the Application, your user account and the data contained in Connected Cars’ services as long as you have a user account with Connected Cars, and you agree to receive the information and digital marketing notifications specified in these Conditions of Use and the associated Personal Data Policy. Your right to use the Application and the services offered by Connected Cars continues until you or Connected Cars terminate the right of use by giving notice of termination or by other means pursuant to section 12 of the Conditions of Use.
3 - Username and password
In the course of the registration process, you will be asked to give your email address and select a password. You are responsible for the confidentiality and use of your password and you must log off the account after use. Your password is personal and must not be used by a third party. If you suspect that your password is being misused, you must immediately notify Connected Cars thereof and, at the same time, change your password. If Connected Cars has reason to believe that your password has been communicated to a third party or otherwise misused by unauthorised parties, Connected Cars is entitled to close your user account with immediate effect. Connected Cars may at any time demand that you change your password. Changes must be made immediately and may cause temporary disruption when using the Application. Connected Cars provides the option for access to your user account via social media (Facebook, etc.). If you use social media to access your user account, you should be aware of the information that the social medium in question receives about use of the Application via the cookies used by the social medium in question.
4 - Legal and regulatory requirements
Without prejudice to other provisions of the Conditions of Use, you must use the Application in accordance with national and international laws and regulations in force from time to time. Connected Cars may not be held liable if you do not comply with current legislation and regulations.
5 - Intellectual property rights
All intellectual property rights to the Application and data in the Application, including but not limited to copyrights, trademarks, logos and domain names, are owned by Connected Cars. There is nothing in the Conditions of Use that entitles you to use such intellectual property rights.
6 - Limitation of liability
The Application is provided ‘as is’. Connected Cars expressly disclaims any liability and any guarantee, regardless of whether the guarantee is explicit, implicit or compulsory, including guarantees of suitability for a specific purpose, title, non-infringement, and that information collected via the Application is accurate, complete or reliable. Connected Cars may not be held liable for direct or indirect losses in connection with use or content of the Application, data associated therewith, the Websites or any other Connected Cars service or delivery. Thus, Connected Cars may never be liable for losses, neither direct nor indirect, including operating losses, loss of profit, loss of usage, loss of data, other indirect losses or consequential losses.
7 - Privacy
You can read Connected Cars’ Personal Data Policy under the menu item ‘Personal Data Policy’. The policy explains your rights and Connected Cars’ liability with regard to collection and processing of personal data via the Application and the hardware that has been installed in your vehicle.
8 - Cookies
Connected Cars stores a cookie on the device that you use to access the website with a view to providing you with a user-specific experience.
9 - Availability of the Application
Connected Cars cannot guarantee uninterrupted access to the Application. If you experience problems when you use the Application or that a download link does not work, please contact us at firstname.lastname@example.org.
10 - Partial invalidity
If a provision of the Conditions of Use is declared invalid, such provision must be replaced with a provision that comes closest to the intention underlying the original provision, and the remaining provisions of the Conditions of Use will be unimpaired.
11 - Links from the Application
The Application may contain links to websites provided by third parties. Connected Cars has no control over, and assumes no liability for, the content of such websites. Your use of such websites is solely your responsibility and at your own risk.
12 - Termination
You may cancel your user account with Connected Cars by clicking “Close” in the Application or on the Website. Connected Cars may cancel your user account with 30 days’ notice.
13 - Applicable law and venue
Danish law shall apply and Glostrup District Court shall be regarded as the proper venue.

Use of Connected Cars’ Application and services gives you:
- regular useful information about your vehicle in the Application
- an option for easy communication with your preferred garage
- user-specific advice and relevant offers from Connected Cars, your preferred garage, Skandinavisk Motor Co. A/S and Semler Retail A/S
You agree that as long as you use the Application and Connected Cars’ services:
- Connected Cars may collect and process personal data about you as the vehicle’s owner/user
- Connected Cars may pass on certain information, master data, etc. about you to your preferred garage, Skandinavisk Motor Co. A/S and Semler Retail A/S such that they may send you relevant offers and information about your vehicle
- Connected Cars may pass on certain information to SOS Dansk Autohjælp A/S such that your vehicle may be transported to your preferred garage if a violent collision is registered
- Connected Cars may pass on certain information to relevant authorities to ensure that you receive best possible help if a violent collision is registered
- You will receive information and relevant offers in the form of direct electronic marketing from Connected Cars, your preferred garage, Skandinavisk Motor Co. A/S and Semler Retail A/S
2 - Introduction
It is important to Connected Cars A/S (“Connected Cars”) that your personal data are stored and processed securely and legally. For this reason, we have prepared this personal data policy (“Personal Data Policy”) describing the way in which we collect and process your personal data. You are encouraged to read this Personal Data Policy carefully, and you will be asked to confirm that you have read and accepted the Personal Data Policy when you sign up for Connected Cars’ services via the Connected Cars application (“the Application”), via Connected Cars’ website or via your preferred garage’s website (“the Websites”). “You” refers to the owner and/or the person who has primary access to the vehicle in which Connected Cars’ device is installed. The Connected Cars device is the physical box (hardware) that collects and sends data from the vehicle to Connected Cars and is used for the Application. The Personal Data Policy is in force from 1 May 2017. In the event of any changes to the Personal Data Policy, you will receive push notifications to your smartphone and/or other selected digital contact points as well as when you log onto the Application or the Websites. At the same time, you will be asked to read and accept the changed terms and conditions. Personal data are collected and processed in accordance with legislation on processing of personal data in force from time to time. 3 - Registration of data
3.1 - Master data
When you sign up for Connected Cars’ services, the following master data about you will be registered:
- Email address
- Telephone number
- If applicable, Facebook account
- Your preferred garage
You are encouraged to check that all registered master data are correct and to update them if necessary. You may update your master data when you log onto the Application or when you log into your profile on the Websites. If Connected Cars becomes aware that information about you is incorrect or misleading, Connected Cars is entitled and obliged to correct or delete the information such that processing is carried out on an accurate basis.
3.2 - Data from the vehicle
The hardware installed in your vehicle (Connected Cars’ device) ensures that the following data are regularly collected from your vehicle:
- Position (GPS)
- Acceleration (Gyroscope)
- Technical data from the vehicle (information about faults, status of systems and operational temperature and pressure in systems)
4 - Use of data
4.1 - General
The Application and the underlying cloud infrastructure establishes communication between you, your vehicle, Connected Cars and your preferred garage.
If you wish to use the Application and Connected Cars’ services, you accept and agree that Connected Cars registers and processes your data and that some of your data will be shared with Connected Cars’ primary partners – Skandinavisk Motor Co. A/S, Semler Retail A/S, your preferred garage and SOS Dansk Autohjælp A/S – as long as you are registered with Connected Cars via the Application and/or via the Websites.
The identity and contact details of your preferred garage can be seen in the Application and on the Websites.
You can receive data from your vehicle about its condition via the Application. Similarly, your preferred garage can see data from your vehicle. Based on the technical data from your vehicle, your preferred garage can help you take care of the vehicle, e.g. service, maintenance and relevant options and offers for you regarding the vehicle. Finally, you can communicate easily and digitally with your preferred garage using your preferred channel of communication: email, text or Facebook Messenger – all from the Application. As an element of the Application, you will receive targeted offers from Skandinavisk Motor Co. A/S and Semler Retail A/S (as described in section 4 below) concerning ways in which they may help you look after your vehicle as well as other offers relevant to vehicles, adapted to your needs. In addition, you will be able to use the Application to choose to share selected information about yourself and your vehicle with other Connected Cars partners in order to receive offers adapted to your needs. Your personal data will only be shared with Connected Cars’ other partners if you have given specific consent to share your data. If you wish to give consent for Connected Cars to share your personal data with Connected Cars’ partners, you will be told before you give consent precisely which information you are selecting to share and with whom.
4.2 - Use of master data
In connection with use of the Application, we register a range of master data about you, cf. section 3.1. These data are used to match data from the vehicle with you as the user of the car. This allows the Application and your preferred garage to contact you, for instance with information about the condition of your vehicle.
4.3 - Data from the vehicle
- Vehicle’s position - Purpose: This information is collected on an ongoing basis while the vehicle is running in order to enable assistance to be sent to the vehicle’s position in the event of an accident and to provide the user of the vehicle with information about the position of the vehicle and trips made. Neither your preferred garage nor Connected Cars’ other partners have access to the vehicle’s position at any time. The vehicle’s position is given to SOS Dansk Autohjælp A/S if a violent collision is registered. SOS Dansk Autohjælp A/S also discloses certain information to the authorities if a severe collision is detected.
- Effects of the vehicle’s acceleration - Purpose: This information is collected on an ongoing basis while the vehicle is running with a view to gauging whether the vehicle is in danger of a collision and to advise the driver on more efficient and safer motoring via the Application.
- Technical data - Purpose: Data from the vehicle’s own computer systems which show the status of the vehicle in real time. Signals can be divided into three categories: fault reports, status of the vehicle’s user applications (e.g. ‘the car is locked’) and operating parameters such as pressure and temperature readings. All signals are collected on an ongoing basis in the vehicle, most of which are sent to Connected Cars at fixed intervals. Important notifications are sent immediately and used to draw the driver’s attention to a situation as soon as it arises. Technical parameters are collected to provide the user with information about the status of the vehicle and to enable the user’s preferred garage to advise the user based on technical information from the vehicle.
5 - Partners
Connected Cars collaborates with other companies in order to be able to give you the best offers and the best functionality. Connected Cars’ primary partners are:
- Skandinavisk Motor Co. A/S
- Semler Retail A/S SOS Dansk Autohjælp A/S
- SOS Dansk Autohjælp A/S
SOS Dansk Autohjælp A/S cooperates with the authorities and will pass certain information to the authorities if a major collision is detected. When you agree to receive offers from one of Connected Cars’ partners, you are also agreeing that Connected Cars may pass on data processed by Connected Cars to the partner in question. If you choose to accept an offer from one of Connected Cars’ partners, you enter into a direct relationship with the partner in question who will then be able to register the data you give directly to the partner in question. It is a condition for receipt of Connected Cars’ services that you agree and consent to Connected Cars sharing your data with Skandinavisk Motor Co. A/S, Semler Retail A/S and your preferred garage. This includes your agreement and consent to receive information and marketing materials from Connected Cars, Skandinavisk Motor Co. A/S, Semler Retail A/S and your preferred garage as long as you receive Connected Cars’ services.
6 - Right of access and rectification
You are entitled to contact Connected Cars at any time for information on which personal data about you are being processed. Similarly, you are entitled to access to the data in question. You are also entitled to have any incorrect data about you corrected by Connected Cars without unnecessary delay.
7 - Deletion of data
If you no longer wish to be signed up to Connected Cars’ services, you may unsubscribe at any time via the Application or the Website. As a general rule, Connected Cars will delete all personal data about you 30 days after you unsubscribe from Connected Cars’ services. Furthermore, Connected Cars is obliged to delete parts or all of your personal data if one of the following conditions applies:
- The personal data are no longer necessary to serve the purpose of collection and processing of personal data as described above in section 3, for example if you sell the vehicle;
- You withdraw your consent; or
- The personal data have been processed illegally.
8 - Objection and withdrawal of consent
You are entitled at any time to raise an objection and/or withdraw your consent to processing of your personal data. If you raise an objection or withdraw your consent, Connected Cars is no longer entitled to process your personal data, and Connected Cars will subsequently be obliged to delete your personal data. If you wish to raise an objection and/or withdraw your consent to processing of your personal data, you may contact Connected Cars via the Application or the Websites or at Park Allé 355, 2605 Brøndby, Denmark, email: email@example.com. You may also contact your preferred garage.
9 - Data portability
You are entitled at any time to receive the personal data you yourself have given to Connected Cars in a structured, commonly applicable and machine readable format. Similarly, you are entitled to transmit these data to another data administrator. If it is technically possible, you are entitled to have your personal data transmitted directly from Connected Cars to another data administrator.
10 - Security
The Application and the underlying cloud infrastructure are designed to have a high level of security, focusing on protection of data. Connected Cars monitors that the necessary technical and organisational security measures are in place to prevent accidental or illegal destruction, loss or impairment of personal data and to protect personal data from disclosure to unauthorised parties, misuse or otherwise being treated in a manner contrary to legislation on processing of personal data. Thus, data is transmitted from your vehicle via an encrypted, secure connection, and the servers on which the data are located are protected by leading security measures. Finally, access to data is managed based on a principle of necessity. This means that only a few highly trusted people have access to data, and their activities are always monitored. This applies to Connected Cars, Connected Cars’ partners and Connected Cars’ data processors. One example of implementation of the principle of necessity is that your vehicle’s position will be available to SOS Dansk Autohjælp A/S as well is in certain instances the relevant authorities such that they may dispatch assistance in a collision situation where there may be injured persons.
11 - Complaint procedure
You may submit a complaint about collection and processing of personal data by contacting Connected Cars A/S by email: firstname.lastname@example.org. You may also file the complaint with the Danish Data Inspectorate, Borgergade 28, 5., 1300 Copenhagen K, Denmark.
